Is Kratom Legal in the United States?

Kratom (Mitragyna speciosa), a tropical tree native to Southeast Asia, has gained popularity in the United States in recent years. Kratom is not approved for medical use by the Food and Drug Administration (FDA), and there is ongoing debate about its safety and potential for abuse and addiction.

At the federal level, kratom is not currently illegal or controlled under the Controlled Substances Act. In 2016, the Drug Enforcement Administration (DEA) announced plans to temporarily place the active ingredients in kratom, mitragynine and 7-hydroxymitragynine, into Schedule I of the Controlled Substances Act. This decision was later withdrawn amid public outcry and a request from members of Congress for further research and public comment.

However, the FDA has warned consumers not to use kratom, citing concerns over its safety and potential for abuse. The agency has stated that kratom has similar effects to opioids and has been associated with 44 deaths. The FDA has also cracked down on companies making unproven health claims about kratom, issuing warning letters and seizing products.

State Laws on Kratom

While kratom remains legal under federal law, a number of states have enacted their own laws banning or regulating the substance:

  • Six states (Alabama, Arkansas, Indiana, Rhode Island, Vermont, and Wisconsin) have passed laws banning kratom possession and sale.
  • In four states (Arizona, Georgia, Nevada, and Utah), kratom is legal but with some regulations in place, such as age restrictions or labeling requirements.
  • Kratom is also banned in some cities and counties, such as Denver, San Diego, and Sarasota County, Florida.

The Debate Over Kratom
